Dean is licensed to practice law in the State of Texas, including Federal Courts in the Northern and Southern District Texas. Dean’s practice is focused primarily in the area of commercial litigation. Dean has represented clients in a wide array of complex litigation matters involving commercial business disputes, environmental toxic tort, and mass products liability. Specific causes of action include: breach of contract, securities & finance, anti-trust claims, real estate disputes, property development, residential/commercial construction, employment disputes, breach of fiduciary duty, fraud, shareholder & partnership disputes, officer & director liability, wrongful death, manufacture’s liability, premises liability, and general negligence.
Dean is a native of Memphis, Tennessee. Dean graduated from the University of Mississippi where he obtained his Bachelor of Arts in Political Science, with an emphasis on Economic Development. Dean earned his Juris Doctorate from St. Mary’s University School of Law in San Antonio, Texas. While at St. Mary’s, Dean had the opportunity to attend the University of Innsbruck, in Austria, where he focused his studies in International Business Transactions, Global Corporate Governance, and Equal Protection.
Representation Experience
- Obtained dismissal of $50 Million lawsuit for a world leader in the manufacture of COVID tests, along with its president, against claims brought by Swiss medical supply company, for fraud, negligent misrepresentation, civil conspiracy, and aiding and abetting in the District Court for Harris County, Texas.
- Obtained complete summary judgement for prominent North American engine manufacture in toxic tort/wrongful death case, pending in Phoenix, Arizona.
- Obtained voluntarily non-suit via summary judgment on all claims brought against chemical manufacture client in high-profile wrongful death action in Camden, Arkansas.
- Obtained complete dismissal via pre-answer motion to dismiss of class action suit brought against prominent livestock husbandry operation based in Arkansas, for alleged violations of the Fair Labor Standards Act and Arkansas Minimum Wage Act.
- Obtained complete dismissal via pre-answer motion to dismiss on all claims against major travel agency based in Tulsa, Oklahoma against causes of action for breach of contract; insurance bad faith; fraud; and Oklahoma Consumer Protection Act.
- Obtained successful defense for managing members of limited liability company against claims for breach of contract, breach of fiduciary duty, fraud, fraudulent inducement, and conspiracy, involving misappropriation of EB-5 loan proceeds.
- Obtained pre-trial dismissal of certain claims, and favorable final settlement on remaining claims for general contractor client against claims for wrongful death, premises liability, and negligence action.
- Obtained release of proceeds from tax increment financing for real estate developer client after entry of a temporary restraining order to block payment based upon claims of alleged misappropriation.
- Successful defense of suit brought against real estate developer client via plea to the jurisdiction, relating to claims of misappropriation of EB-5 loan proceeds and proceeds from tax increment financing.
- Successful prosecution for limited liability company client against former company officers based upon claims under the Texas Theft Liability Act, conversion, and breach of fiduciary duty.
- Successful defense via summary judgment for residential developer client against claims brought by competing developers, including tortious inferences, misappropriation of trade secrets, and conversion.
