Litigation.

One of the firm's primary practice areas is the representation of residential and commercial builders, contractors and suppliers. In the residential context, homebuilders often face construction defect claims, ranging from "fit and finish" cases to major structural failures, filed by homeowners under the RCLA and the TRCCA dispute resolution procedures. Our lawyers have successfully defended the firm's homebuilder clients in the administrative dispute resolution process under the TRCC, and in formal litigation in the state court or binding arbitration forums. In addition to our residential construction clients, we represent several commercial contractors and suppliers in a variety of claims, including breach of contract, breach of warranty, delay and defective construction claims, as well as suits to enforce or remove mechanics and materialmen liens and surety obligations.

Transactional Assistance.

The firm also offers assistance with drafting and negotiating contract documents, such as lot purchase agreements, home sale, build-to-suit and mechanics' lien contracts, warranty and specifications documentation, subcontractor agreements, change orders and lien waivers. Having the proper documentation can minimize, and often prevent, the exposure to liability when the inevitable dispute arises.
